Terms & Conditions
1. Overview
These Terms and Conditions ("Terms") form a legally binding agreement between you ("Guest", "User", "you") and Kotisauna ("Kotisauna", "we", "us", or "our") regarding your access to and use of our website at kotisauna.ca and your participation in any sauna sessions, programming, events, or other activities offered by Kotisauna (collectively, the "Services").
Kotisauna is an outdoor sauna experience operating at Evergreen Brick Works, a third-party property located in Toronto, Ontario. Sessions take place in an outdoor setting and are subject to variable environmental and weather conditions. By booking a session, you acknowledge and accept the inherent conditions of participating in an outdoor wellness experience.
By booking a session, accessing our website, or participating in any Kotisauna programming, you confirm that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy. If you do not agree, you may not use our Services.
2. Scope of Activities
For the purposes of these Terms, the "Services" and "activities" include, without limitation:
• Use of sauna facilities, cold plunge or contrast therapy equipment, showers, change rooms, washrooms, and all other amenities at any Kotisauna location or pop-up;
• Participation in any sessions, workshops, events, or programming, whether guided or self-led, including hot and cold therapy, breathwork, or other wellness-related activities;
• Use of any equipment, furniture, or products provided by Kotisauna, including benches, buckets, ladles, and seating areas;
• Presence in or movement through all outdoor and indoor areas of any premises operated or used by Kotisauna, including pathways, gravel surfaces, natural terrain, and adjacent areas; and
• Any activities reasonably incidental to the foregoing, including arriving at, waiting at, and departing from the premises.
Kotisauna operates on property owned and managed by Evergreen Brick Works. Evergreen Brick Works is not a party to these Terms and is not responsible for Kotisauna's operations. Guests acknowledge that portions of the broader Evergreen Brick Works site fall outside of Kotisauna's control, and that Kotisauna is not liable for conditions, hazards, or incidents occurring in those areas.
3. Health Disclaimer & Assumption of Risk
Participation in sauna and thermal contrast activities involves inherent physical risk. By using our Services, you acknowledge and agree to the following:
3.1 Medical Responsibility
It is your sole responsibility to determine whether you are physically and medically able to participate in sauna and thermal wellness activities. You represent and warrant that you have no medical condition that would prevent safe participation, including but not limited to uncontrolled cardiovascular disease, uncontrolled hypertension, acute illness, pregnancy, or a known history of fainting or seizures. We strongly recommend consulting your physician prior to your first session.
3.2 Assumption of Risks
I am aware and understand that the activities may involve many risks, dangers, and hazards, including but not limited to the risk of serious injury, death, or property damage. I acknowledge that I am voluntarily participating. I freely accept and fully assume any and all risks, dangers, and hazards involved, and the possibility of injury, death, or property damage, whether caused by the negligence of Kotisauna or otherwise.
As an outdoor experience, I further acknowledge and assume the following risks specific to the outdoor environment:
• Weather and environmental conditions, including rain, wind, lightning, extreme heat or cold, and seasonal temperature variations, that may affect the safety or comfort of participation;
• Outdoor terrain hazards including gravel pathways, uneven ground, natural surfaces, wet or icy conditions underfoot, and limited artificial lighting during low-light or evening sessions;
• Exposure to insects, including stinging insects such as bees and wasps, and other wildlife that may be present in an outdoor urban natural setting;
• Reduced visibility during sessions held at dusk or after dark, which may increase the risk of slips, trips, or falls on outdoor surfaces.
3.3 Release and Waiver
I hereby expressly waive and release any and all claims which I have or may in the future have against Kotisauna, its affiliates, directors, officers, employees, agents, representatives, successors, and assigns (collectively, the "Releasees"), arising out of or related to the activities — including while on my way to, while at, and while leaving any premises — due to any cause whatsoever, including the negligence of Kotisauna or any other Releasee, breach of contract, or breach of any statutory or other duty of care.
I covenant not to make or bring any such claim against Kotisauna or any other Releasee, and forever release and discharge Kotisauna and all other Releasees from liability under such claims. I shall indemnify, defend, and hold Kotisauna and all other Releasees harmless against any losses, damages, liabilities, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses, including reasonable legal fees, arising from any third-party claim resulting from the activities.
3.4 Limitation of Liability
In the event that a court of competent jurisdiction determines that the release of claims set forth herein is not valid, I agree that in no event shall the Releasees' aggregate liability arising out of or related to the activities exceed the greater of: (i) the total amount paid by me to Kotisauna in the six (6) months preceding the event giving rise to the claim; and (ii) $500 CAD.
3.5 Safe Conduct
I agree to conduct myself in a safe and reasonable manner at all times. I will not participate in activities while under the influence of alcohol or recreational drugs, and I will not consume alcohol or drugs on premises. I will immediately notify staff if I experience dizziness, chest pain, nausea, or any other concerning symptoms, and I will exit the sauna immediately if I feel unwell.
4. Safety & Facility Conditions
Kotisauna is an outdoor facility. Sessions take place in a natural outdoor environment at Evergreen Brick Works and are subject to the conditions inherent in that setting. Guests agree to:
• Follow all posted signage and staff instructions at all times;
• Exercise caution when moving through all areas of the facility, including outdoor pathways, gravel surfaces, change rooms, showers, and relaxation spaces, and take particular care on uneven, wet, or icy surfaces;
• Dress appropriately for outdoor weather conditions and take personal responsibility for comfort and safety in variable temperatures;
• Limit sauna sessions to durations appropriate to their personal health and tolerance;
• Use the facility in a manner that respects other guests' safety and experience.
Kotisauna reserves the right to refuse entry to, or remove, any Guest acting in an unsafe or inappropriate manner, without refund.
In the event of illness or injury on premises, you authorize Kotisauna and its staff to provide first aid or obtain emergency medical treatment as deemed necessary. You accept full responsibility for any associated costs.
5. Eligibility
You must be 18 years of age or older to book and attend Kotisauna sessions. By completing a booking, you represent and certify that you are 18 or older and legally able to enter into binding agreements with Kotisauna and its partners, vendors, agents, and service providers.
Guests under 18 may only attend designated Family Sessions, and must be accompanied by a parent or legal guardian for the duration of the visit. A waiver must be signed on-site by the parent or guardian prior to participation. The accompanying adult assumes full responsibility for the minor's conduct and safety on premises. Kotisauna reserves the right to refuse entry to any minor whose parent or guardian has not completed a waiver.
6. Booking, Payments & Cancellations
6.1 Reservations
All session bookings are subject to availability. Kotisauna reserves the right to limit, cancel, or modify availability at any time. Reservations are not confirmed until payment is received in full.
6.2 Pricing
All prices are quoted in Canadian dollars and are subject to applicable taxes. Prices are subject to change without notice. The price in effect at the time of booking applies to that booking.
6.3 Cancellations & Refunds
Full refunds are available for cancellations made at least 12 hours before the scheduled session start time. Cancellations made within 12 hours of the session are non-refundable. No-shows forfeit the session and are not eligible for a refund or credit. To cancel a booking, please contact us at sweat@kotisauna.ca.
6.4 Weather & Kotisauna-Initiated Cancellations
Kotisauna operates outdoors and reserves the right to modify, shorten, suspend, or cancel any session at any time due to weather, lightning, extreme temperatures, or other conditions that Kotisauna determines pose a risk to guest safety. In the event of a Kotisauna-initiated cancellation, affected guests will receive a full credit toward a future session. Refunds for weather cancellations will be issued only where a guest is unable to rebook within the current season. Kotisauna is not responsible for any costs incurred by guests in connection with a cancelled session, including travel or parking costs.
6.5 Late Arrivals
Guests who arrive late will not receive an extension of their session time. Your session ends at the originally scheduled time regardless of arrival. We encourage all guests to arrive a few minutes early to allow time to settle in.
6.6 Payment Processing
Payments are processed through a third-party payment processor. By completing a transaction, you agree to the terms and privacy policies of that payment processor in addition to these Terms. Kotisauna is not responsible for errors by third-party payment processors.
7. Session Packs
Kotisauna offers prepaid session packs that provide access to a set number of sessions at a discounted rate. The following terms apply:
• All prepaid session packs must be used by December 31, 2026. Unused sessions expire on that date and are not eligible for refund or credit.
• Session packs are non-transferable and may only be used by the purchaser.
• Individual sessions within a pack are subject to the same cancellation and late arrival policies outlined in Section 6.
• Kotisauna is not responsible for sessions that expire due to scheduling delays or infrequent use.
8. Personal Property
Kotisauna is not responsible for the loss, theft, or damage to any personal property brought onto the premises, regardless of cause. Guests are encouraged to leave valuables at home and to use any available secure storage at their own risk.
9. Photography & Media
Photography and video recording of other guests without their express consent is strictly prohibited on Kotisauna premises. By participating in Kotisauna programming, events, or community sessions, you consent to being photographed or filmed by Kotisauna for use in marketing, social media, and communications materials. If you do not wish to appear in such materials, please notify staff before your session.
10. Community Standards
Kotisauna is built on the belief that sauna is for everyone. All guests are expected to treat each other and our staff with respect. The following will not be tolerated:
• Threatening language, harassment, bullying, or intimidation directed at any person;
• Discrimination based on race, colour, ethnic origin, religion, disability, gender identity, age, sexual orientation, or any other protected characteristic;
• Behaviour that endangers the physical safety or wellbeing of any person on premises.
Kotisauna reserves the right to remove any Guest who violates these standards without refund.
11. Website Use
Your use of kotisauna.ca is subject to these Terms. You agree to use the website only for lawful purposes and not to interfere with its operation, attempt to gain unauthorized access, or post content that is false, misleading, defamatory, or infringes on the rights of others.
All content on kotisauna.ca — including text, graphics, logos, images, and software — is the property of Kotisauna or its licensors and is protected by applicable intellectual property laws. No material may be reproduced, distributed, or used without prior written permission.
12. Privacy
We collect and use your personal information in accordance with our Privacy Policy, available at kotisauna.ca. By using our Services, you consent to the collection and use of your information as described therein. All prices are quoted in Canadian dollars.
13. Governing Law
These Terms shall be interpreted and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute, claim, or cause of action arising under or relating to these Terms or your use of our Services may be brought only in the courts of the Province of Ontario, and you hereby consent to the exclusive jurisdiction of such courts.
Les parties aux présents ont exigé que la présente convention ainsi que tous les documents et avis qui s'y rattachent ou qui en découleront soient rédigés en la langue anglaise. The parties have required that this agreement and all documents and notices resulting from it be drawn up in English.
14. Severability & Entire Agreement
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed and the remaining Terms shall continue in full force and effect.
These Terms, together with the Privacy Policy and any other policies posted on our website, constitute the entire agreement between you and Kotisauna with respect to your use of the Services and supersede all prior agreements and understandings.
15. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the date at the bottom of this document. Your continued use of our Services after any changes constitutes your acceptance of the updated Terms. We will endeavour to notify you of material changes via email or a notice on our website.
