How our documents fit together. These Terms cover bookings, payments, cancellations, session packs, guest conduct, photography and our website. Your participation, and the risks that come with it, are covered by our Waiver & Release of Liability, which every guest accepts for every booking.

1. About These Terms

These Terms and Conditions ("Terms") are a legally binding agreement between you ("Guest", "you") and Kotisauna Inc. ("Kotisauna", "we", "us", "our"). They apply to your use of kotisauna.ca, your bookings and purchases, and your visits to any Kotisauna session, program or event (together, the "Services").

Participation in the Services is also governed by our Waiver & Release of Liability ("Waiver"). The Terms, the Waiver and our Privacy Policy are meant to be read together. If they conflict, the Waiver governs on matters of risk, safety and liability, and these Terms govern on everything else.

You accept these Terms when you make a booking, purchase a session pack or use our website. If you do not agree, please do not use the Services.

2. Who We Are

Kotisauna is an outdoor community sauna operating seasonally at Evergreen Brick Works in Toronto, Ontario, under an agreement with Evergreen. Evergreen and the owners of the property do not operate Kotisauna and are not party to these Terms. The 2026-27 season runs until May 31, 2027.

Common areas, including the parking lot, the pavilion and other shared spaces outside the Kotisauna sauna area, are managed by Evergreen. Kotisauna is not responsible for their condition, including snow and ice clearing, or for parking.

3. Eligibility & Age

You must be 18 or older to make a booking. We may ask for proof of age.

Guests aged 12 to 17 may attend when accompanied by a parent or legal guardian for the entire visit. Guests under 12 may not participate.

Before a young person participates, their parent or guardian must accept the Waiver for themselves and sign a separate Parent or Guardian Acknowledgement on site. The accompanying adult is responsible for supervising the young person and for their conduct and safety.

We will refuse entry to any young person whose parent or guardian has not completed these documents.

4. Bookings

4.1 Reservations

All bookings are subject to availability. A reservation is confirmed only once payment is received in full.

4.2 Every guest accepts the Waiver

Every guest must personally accept the Waiver for every booking. If you book for other people, you are responsible for sharing these Terms with them and making sure each of them accepts the Waiver before the session. You cannot accept the Waiver on behalf of another adult. Any guest who has not accepted the Waiver must do so at check-in, and we will refuse entry to anyone who does not.

4.3 Arrival and late arrivals

Please arrive 10 minutes early. Each session begins together as a group. Sessions end at the scheduled time regardless of when you arrive, and late arrivals do not receive extra time.

5. Prices & Payment

All prices are in Canadian dollars and are subject to applicable taxes.

The price in effect at the time of booking applies to that booking. Prices for future bookings may change.

Payments are processed by a third-party payment processor. By completing a transaction, you also agree to that processor's terms and privacy policy. Kotisauna is not responsible for errors made by the payment processor.

6. Cancellations & Refunds

• Cancellations made at least 12 hours before the session start time receive a full refund.
• Cancellations made less than 12 hours before the session are non-refundable.
• Private group sessions: cancellations made at least 24 hours before the session start time receive a full refund. Cancellations made less than 24 hours before are non-refundable.
• No-shows forfeit the session and are not eligible for a refund or credit.
• Guests refused entry or removed under Sections 3, 4.2 or 9 are not eligible for a refund or credit.

7. Weather & Kotisauna-Initiated Changes

Kotisauna operates outdoors. We may modify, shorten, suspend or cancel any session at any time due to weather, lightning, extreme temperatures, equipment issues or any other condition we believe poses a risk to guest safety. We will let affected guests know by email as early as we can.

• If we cancel a session, affected guests receive a full credit toward a future session.
• If you are unable to rebook within the current season, we will issue a refund instead.
• We are not responsible for costs you incur in connection with a cancelled session, such as travel or parking.

Please dress for the conditions and check the forecast before you come. Winter sessions run in sub-zero temperatures.

8. Session Packs

Session packs give you a set number of sessions at a discounted rate.

• Session packs expire at the end of the season in which they are purchased. Packs purchased for the 2026-27 season expire on May 31, 2027. Unused sessions are not eligible for a refund or credit after that date.
• Session packs are non-transferable and may only be used by the purchaser. Staff session packs bought by an organization may be used by its staff.
• Each session booked with a pack is subject to the cancellation and late arrival policies in Sections 4 and 6.
• Kotisauna is not responsible for sessions that expire due to scheduling conflicts or infrequent use.

9. Guest Conduct & Community Standards

Kotisauna is built on the belief that sauna is for everyone. We expect every guest to treat other guests and our staff with respect, follow posted signage and staff instructions, and follow the safety responsibilities set out in the Waiver.

The following will not be tolerated:

• threatening language, harassment, bullying or intimidation;
• discrimination based on race, colour, ethnic origin, religion, disability, gender identity, age, sexual orientation or any other protected characteristic;
• bringing or consuming alcohol, cannabis or other drugs on the premises, or attending while impaired; and
• any behaviour that endangers the safety or wellbeing of any person.

We may refuse entry to, or remove, any guest who breaks these standards, without refund.

10. Photography & Media

Respect other guests. Photographing or recording other guests without their express consent is prohibited.

Our photography. Kotisauna sometimes photographs or films sessions and events for marketing, social media and communications. At booking, you can choose whether you consent to being featured. We will only feature you as an identifiable subject if you have opted in.

Changing your mind. You can withdraw your consent at any time by emailing sweat@kotisauna.ca. We will stop using those images in new materials, but cannot recall materials already published or printed.

Young people. We only photograph guests under 18 with their parent or guardian's written consent on the Parent or Guardian Acknowledgement.

11. Personal Property

Kotisauna is not responsible for the loss, theft of, or damage to personal property, as set out in the Waiver. Please leave valuables at home. Any storage we provide is used at your own risk.

12. Liability

Your participation in the Services is at your own risk and is subject to the assumption of risk, release, indemnity and limitation of liability in the Waiver. Nothing in these Terms limits any right you have under Ontario consumer protection law that cannot be waived by agreement.

13. Website Use

You agree to use kotisauna.ca only for lawful purposes and not to interfere with its operation, attempt to gain unauthorized access, or post content that is false, misleading, defamatory or that infringes the rights of others.

All content on kotisauna.ca, including text, graphics, logos, images and software, is the property of Kotisauna or its licensors and is protected by intellectual property laws. No material may be reproduced, distributed or used without our prior written permission.

14. Privacy

We collect and use your personal information in accordance with our Privacy Policy at kotisauna.ca. This includes keeping a record of each Waiver acceptance (your name, the date and time, and the version accepted) and your photography preference. By using the Services, you consent to this collection and use as described in the Privacy Policy.

15. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict of law principles. Any dispute arising from these Terms or the Services may be brought only in the courts of Ontario, and you consent to their exclusive jurisdiction.

16. Severability & Entire Agreement

If any provision of these Terms is found invalid or unenforceable, it will be severed and the rest will remain in full force.

These Terms, the Waiver and our Privacy Policy are the entire agreement between you and Kotisauna about the Services and replace any prior agreements or understandings.

17. Changes to These Terms

We may update these Terms from time to time and will post the updated version with a new date. The version in effect when you make a booking applies to that booking. We will let you know about material changes by email or a notice on our website.
